Well look at it this way, despite being different franchises, The Donkey Kong games are still in the Mario Extended Universe, like the M&L games.

actually! fun fact! Mario 2 was actually fully developed by Nintendo. Nintendo was commissioned to make a game for The Fuji Television company, called Doki Doki Panic. Nintendo themselves thought Doki Doki Panic was really similar to Mario as well during development. The four main characters weren't legally owned by Nintendo, but they owned everything else. So legally, they didn't rip anything off, they just recycled a game

Well, atleast there's Petey Piranha.

Seriously, Donkey Kong is a Mario character, but other characters from Donkey Kong games are not, because they did not originate from Mario games. Like how Shy Guys are not Mario characters. They first appeared in Mario 2. Mario 2 is a shameless ripoff of a less popular game, and some things where not changed. Shy Guys where one of the unchanged things, so they just stayed and became a "Mario character"
