I have updated this patch. The servant portrait trinkets should work as intended with 3 non-lethal attacks requirement.
Sorry for the late reply, I have confirm that this bug does exists due to ActorDot override rule. I shall update this patch after finishing more tests, and thank you again for the report.

Before that, please make sure this patch is sorted above the base mod,
and does not enable the Old Version Hymm Rollback Patch at the same time,
and have not restarted in-combat (this is a bit complex to explain, you may view the details in my guide about the overflows: due to the way how unofficial fix patch fix the ActorDot crash, when players restart in combat, owner-less ActorDots will become permanent and stuck in their current element duration, which always trigger the same effect. If the servant portrait ActorDot is stuck in empty element duration, then it will never trigger anything when non-lethal attack. If the servant portrait ActorDot is stuck in activate element duration, then it will always trigger when non-lethal attack).
