Attack an enemy settlement, win the battle then you will be given a choice to Expand Under-Empire.

You attack the same settlement the 2nd time and take it. You'll Under-Empire will be there.

@GReeceI cannot do that, you will have to carry an engineer with your army to build the undercity before your army takes them.
