Also, Nintendo didn't file suit over the Plumber's Cap because the design is too ambiguous to be considered copyright infringement. If they had put an M on the cap instead of the E, Nintendo could've gone after it because the M is really the only thing connecting it to Mario besides potentially the mustache. The Dying Light easter egg is okay because they only used the layout of the level. Everything else was deliberately designed to avoid looking like Nintendo made it, including the background.

Japanese law does not cut off your hands for stealing, at least not formally. They have a court system just like the US, though they have a "guilty until proven innocent" policy so most people who are arrested end up being convicted and receiving some form of punishment usually involving jailtime.

Kitsune, that's not how it works. The third-party content on consoles was okay because Nintendo actually made agreements with those third-parties. This isn't authorized by Nintendo in any way, and they would definitely file suit if this was added because it's a blatant copy of one of their designs and not applicable for fair use. People have been making Mario references for decades but most of them are decidedly fair use by using them as parody, such as one Simpsons episode having a parody of the original Donkey Kong.

Much as I really love the execution of this item I really do think that it needs a redesign for its red body both due to copyright reasons and because I think there’s better options for a more creative body.

If I remember VALVE AND PLAYSTATION AND XBOX releasing LOOTBOXES which are a form of gambling. And attacking people who reference their games? What 'bout Amazing World of Gumball? I know they made a lot of Mario and Zelda references. Valve just released A CARBON COPY of Mario's signature hat (only notable changes are the e and the mustache other than that it is). Dying Light made a reference in the form of THE ENIRETY OF LEVEL 1-1 FROM SMB. YOUR POINT IS INVALID!

I mean, don't get me wrong: I'd love to see this in game, but the odds of it being added are practically null. You would need to steer the design away from something that looks like Nintendo made it for it to have any realistic chance at being added.
