in other words Nintendo doesn't own names to half of their characters but they do own the designs for the characters

Changing the name doesn't work. Nintendo doesn't own the names but they do own the designs of their characters. this logic will also apply to the person DMCAing stuff. Don't rename the characters you just have to not include any images of the character. so naming characters, mario, Luigi, Bowser, peach and other characters which don't include characters that have names that Nintendo came up with, are good use.
