Pretty much one or the other, though if you stop the Arbiter, you'll end up 'saving' her anyway, since her husband will end up busting her out once the Law's been canceled.

I Found out after a little exploring after the end of the game, I just assumed they dissapeared as I couldnt find them turns out they left to go somewhere else

If you free her she kills the jarl in the bathroom before he can make the time portal.
