I believe I saw an answer when this was previously reported that this is as intended, as administrator he only appears on land battle map when CIS is defending on land. And this I can confirm, I killed him on land as republic when attacking. I.e. you cannot use him in land battles as CIS on the offensive, only on the defensive.

As stated this is intended, he is supposed to be a sneaky background figure for the CIS. If he's cornered on a planet then of course he'll defend himself, but he is not going to join invasion armies, that's not his style at all.
