TF2, HL2 and Portal are made by different teams, and thus they have to pass it through the appropriate other team to allow such an item.
On the headcrab and portal gun, there likely wasn't enough modification, though. If the creator went with the original model imported from Portal or HL2 that definately wouldn't be allowed.
The Ap-Sap was an original work they didn't just take the Wheatly model from the game files and reskin the sapper, they acually made the model and animations, unlike this were they just took Glados' head from the Portal game files and put it on the Pyros head and called it original.
This is an original model and skin. If you have ever played portal 2 (that I doubt seriously) you'll see that the only similarity to the original glados head is the look of the front. This is under 1000 polys, original sure not, and the texture is absolutely diferent.
At least, please see an photo of glados in google, you'll look a little less moron.
