The hat's too close to another hat I have, "Das Blutliebhaber"
I'm not sure if the scarf is seperate (Probably not), but top hat and glasses is something that's already been done, so chances are, Valve won't accept this.

You could make the hat seperate from the glasses and scarf, or maybe the glasses seperate from the hat and scarf, but I'm not sure how it would look on it's own.

The scarf is not separate. so the chances are that they will accept this, cus your hat is too close to the Ebeneezer.

Das Blutliebhaber is halloween restricted which means that it's very rarely used and Valve have added cosmetics that are essentially unrestricted halloween cosmetics before. There are also tons of hats similar to each other.

How many low, wide brim hats do we have for spy?
I think scout has 3 different tracksuits to wear
Soldier literally has two different bald eagles that can sit on the same shoulder because valve didn't care to see if they already had a bald eagle cosmetic for soldier.

This thing is distinct enough to be its own thing and very distinct together with the scarf. Seeing again how Das Blutliebhaber is halloween restricted there won't be any confusion between them if you ask me.
