When it comes to creating a fan-art avatar either 2D and 3D as an independent artist, is best that you are aware of the legal aspect. Since we are not lawyers, we cannot give you legal counsel on this matter but in this video https://www.youtube.com/watch?v=xKBsTUjd910 you will find a LOT of information on the subject given by an actual lawyer with a lot of experience on copyright law.
