2. 100% free fonts from the interwebs are fines aswell i guess. I think you just have to make sure that overkill doesn't need any special permissions for them.

Im not entirely sure but I believe DAFonts has "100% free" option but Im not sure if it means for private use or any use so do list out what fonts you use so devs can check if they can use it easier

100% free usually means that you can download the font and use it for whatever you want (except the creator put a extra "legal.txt" or "permission.txt" with more info for what you can use it into it, what they mostly do.)
Private use is for when you need stuff for yourself and not get paid for it. Otherwise you gotta pay for it, or in this case Overkill would have to pay for it since it's their game.

there are 2 type: free to use and free to use for personal only... sometimes people doesnt know that.
