Same reason why the victims that occur during a crime, like for example a bank robbery, are imputed to the perp even if the police are at fault for it.

Like for example, using the same bank robbery example. If the police barge in start shooting and hit hostages, the perps will be blamed for it even if they didn't kill any hostages themselves, because the situation wouldn't have happened in the first place if the perps didn't do the crime.
