Punishment has nothing to do with it.
Laws against murder are grounded in ethical principles, but that’s for killers. We tend to make room for unintentional murders.

Would you consider it “scummy” to not pull the switch and allow 5 to be killed vs 1? Technically, there’s no law that would punish you, but that’s not the point here.
The people who think what is legal is good and what is illegal is bad have a different mindset, and you wouldn't describe that mindset as "liberal" or "opposing fascism".

Legality means nothing ethically or morally. A thing being illegal has no correlation to whether it is bad or good.
So act ethically, and if that involves breaking the law, avoid being caught.
