It remains legendary. In fact, it has to because of how the item world works. For example, you're leveling a rarity 7 item, and you're on floor 71 when you get a mystery gate with a collector. The collector would make it rarity 8, but if it became a rare instead, you wouldn't even have a floor 71 to return to. So it has to stay legendary to prevent that sort of thing.
