They have to decide it which can be encouraged by getting a good diplomatic relationship with them, you will have to declare war otherwise. Getting cut off is quite unfortunate

Not sure if this will work but it should. If you are on enemy territory, could you try to tell the units to move to your territory/neutral one? What tends to happen is that if you click in an area that belongs to them it tells you that you cant, but if you click on your territory then it works (it was the case in HK, and i think it is the case here.

Had a similar issue when my stack went exploring through the AI's territory which had open borders at that time. They closed the borders and now my stack can't return because AI's territory cover land from one sea to other (top to bottom). My stack at that time was on a neutral territory, so it couldn't go back until borders got opened again.
