It's probably similar; it's my understanding that Gearbox worked on Samba de Amigo and Aliens. It's entirely possible that Sumo looked at the way these games were built and used them as a model for their own titles. Either that or it's just an industry standard or something.
02759 is Casino Park, lifted straight from Sonic Heroes (albeit shortened) and used for Roulette Road. I don't believe the first four bars are used in this game (they weren't in the previous S&SASR either).
Have you told this to the several people who have published game soundtracks all over YouTube; including those that have posted this very game's music? If Sega or Sumo had an issue with this, don't you think they'd be a little faster/harder about stopping people from doing it?
Until someone furnishes documents that say otherwise, I see no problem with this. Furthermore nothing is actually being displayed or used without permission. To infringe copyright would mean you would take the music without permission and use it for something it was not created for without crediting the owner of the music. What we have here are instructions for people to rip the music out of their game for their own personal enjoyment. So long as it's not sold or reused without permission, there's no infringment. There's also the fact that in order to do this, you still have to pay for the game so it's not theft either unless someone tries to sell the music without permission.
Now it would be a completely different matter if someone was trying to rip the music, then pass it off as their own, but that's not what's happening here. The community is very fond of the music and is simply giving themselves a means to enjoy it without having to go through the game to listen to it.
Personally, if I composed the music, i'd be more than ok with it so long as someone isn't selling it without my knowledge. It means people appreciate my work enough to do it and furthermore it's free advertising for the work in question.
Most, if not all, of the tracks that inspired the All-Star musics are far longer. Example: Beat plays Grace & Glory for his All-Star. The specific snippet of his All-Star theme doesn't even start until about forty seconds into the track, and the full Grace & Glory track is about three-and-a-half minutes.
Of course there's an obvious reason why the tracks might be a bit longer, All-Stars only last about ten seconds, I think the only ones you can actually hear the entirety of (excluding FBM and Danica; original works) in-game are Sonic and Tails because their loops are a little shorter than the alloted time (in Ralph's case, the theme has to start a bit late).

It just occured to me, that theme that you couldn't place, is it possible that they left the Xbox360 Avatar's All-Star theme in this version of the game?
