If that doesn't help, my next guess would be a frame rate problem. High frame rates can cause various problems in this game, and apparently has caused crashes for some. One fix for that is to turn on V-Sync. There's more about that in the post below:

Another option is to limit the frame rate in some other way (eg. in the video card drivers, or by using a display, like a TV, with a limited frame rate).
List of things I did:
(in game)
-Enabled V-Sync
-Switched texture quality to Low (not sure if this is necessary)
-Disabled Enhanced Graphics
-Set the refresh rate to 60Hz (in game)
-Switched the rest of the graphics settings (from a separate tab) to OFF
(in system)
-Went into the game files and in the properties (Compatibility tab) of the game’s .exe file I checked:
*Compatibility mode with Windows XP (Service Pack 3)
*Run as administrator
-Changed the monitor refresh rate to 75Hz (probably the lowest value)
(in Nvidia Control Panel) - important, this was the last thing I changed and after that the game started working correctly
As follows -> Manage 3D settings -> Program settings (Choose Lego Batman from the list, if it’s not there, add the .exe file manually)
After selecting the game, in the settings below change:
-(Low Latency Mode) -> Off
-(Vertical Sync / V-Sync) -> On
-(Max Frame Rate) -> 75 FPS or 60 FPS (I personally left it at 75)
-(Triple Buffering) -> On
-(Power Management Mode) -> Prefer maximum performance
-(Threaded Optimization) -> Off
